The 22-year-old who was arrested after allegedly smashing glass doors and breaking into the Ed Sullivan Theater was drunk and has no memory of the incident, says his attorney. James Whittemore "certainly didn't plan this" and doesn't even remember how he got to the theater early Sunday, his lawyer added. A criminal court complaint says Whittemore used a metal stanchion to break several of the theater's glass doors and racked up about $5,000 worth of damage. Though the Late Show set escaped unharmed, pictures, fans, phones, and printers were reportedly damaged. (More David Letterman stories.)
