Murder Trial May Hinge on Dying Man's Blinks

Jury will see videotaped interview with victim

(AP) – An Ohio jury will study a videotape of a dying man's eye blinks before deciding whether he used them to identify his killer. The unusual evidence for the upcoming murder trial of Ricardo Woods in the 2010 shooting of David Chandler in Cincinnati will be key for the prosecution. Jurors will see a videotaped interview of Chandler.

Authorities say it shows the man paralyzed from wounds to his neck and head identifying Woods as his shooter by blinking at certain times for yes and no. Woods' attorney says the blinks were unreliable. A hearing Monday could determine the trial date.

That would be a tough jury to be on.  Hopefully there is enough other evidence that one would not need to assess the likelihood of the validity of the blinks as the only way to judge.
