Nevada court backs NBC's decision to exclude Kucinich

The Nevada Supreme Court ruled that the Democratic debate can go on tonight without Dennis Kucinich, the New York Times reports. The debate will include only Hillary Clinton, Barack Obama, and John Edwards. Kucinich sought either to be included in the debate or to force its cancellation. The debate starts at 9pm EST on MSNBC.

Earlier today, Kucinich won an injunction against NBC, but the network appealed to the state's high court. NBC invited Kucinich to participate last week but said it subsequently revised its criteria after two other candidates dropped out of the presidential race. Kucinich argued that his exclusion was "effectively an endorsement of the candidates selected by NBC.” (More Dennis Kucinich stories.)
