Lindsay Lohan's attorney told a judge yesterday that she was safely "ensconced in the bosom" of a California rehab facility, but she actually never checked in. For a while, as the AP reported, her whereabouts were unknown; she ended up checking into a different California facility late yesterday, TMZ reports. Apparently Lohan spent just a few minutes at Morningside Recovery in Newport Beach, which was already a last-minute switcheroo from the New York facility she originally chose. Morningside had not been approved by prosecutors and it's not licensed for residential in-patient rehab—a problem since Lohan was supposed to be at a lockdown facility.

Lohan "was not happy with the place," dad Michael says of Morningside, according to CNN. "Lindsay had no idea that Morningside wasn't approved." So she ended up at Betty Ford, hours before prosecutors were set to seek an arrest warrant. (The Rancho Mirage facility is the same one where Lohan was accused of brawling with a staffer in 2010.) She also re-hired her old attorney, Shawn Holley, who negotiated the Betty Ford deal for her with the Santa Monica city attorney; now the judge just needs to sign off on it, which he is expected to do. Bizarrely, the New York Daily News spotted her wandering around an electronics store yesterday; that paper says she wanted to fly back to New York, and according to the quotes it got from Michael Lohan, Lindsay really has no grasp of the way the legal system works: "She said, 'Daddy, how can they arrest me?'" says Michael, who convinced her to stay in LA.
