As Supreme Court veers to the right, a new voice of dissent emerges

(Newser) – Ruth Bader Ginsburg has delivered two withering oral dissents in the past six weeks, a radical departure from her previous conciliatory role. Linda Greenhouse speculates in today's Times that the unprecedented behavior may signal a new outspokenness for the Supreme Court's only female justice. "After 15 years on the court, she's finally voicing some complaints," says a former Ginsburg clerk.

On the Rehnquist court, Ginsburg was seen as a peacemaker. Now, it seems, the more conservative course the court is taking has moved her to act. "She is seeing that basic issues she’s fought so hard for are in jeopardy," one longtime friend tells the Times, "and she is less bound by what have been the conventions of the court."

(NEWSER) - Ruth Bader Ginsburg tells the AP , in a roundabout way, that she won't be retiring from the Supreme Court "anytime soon." The significance? Ginsburg is 78 and the court's oldest justice. She's also had health problems , and Democrats' worst-case scenario is that President Obama loses re-election, and Ginsburg has to retire soon afterward. Supreme Court Skeptical About Climate Suit

Justices likely to throw out case brought by states against power plants

(NEWSER) - The Supreme Court looks like it will throw out a major environmental case against coal-fired power plants, reports the Los Angeles Times . The US solicitor general and several justices held that such matters fall under the jurisdiction of the Environmental Protection Agency, and shouldn’t be decided by judges. The high court ruled 4 years ago that the EPA had the power to regulate greenhouse gases, but that didn’t stop six states from pushing the case, which called the plants’ pollution a “public nuisance.” More»
