Dr. Samuel Caruthers' attorney is looking for the verdict to be overturned

On Valentine's Day in 2016, a 12-year-old boy on a snowboard ran into a 10-year-old boy on the bunny slope at New Jersey's Mountain Creek ski resort. The 10-year-old's father didn't take it well—and on Wednesday, he was convicted on a host of charges in what's been called a "ski rage" attack. The jury found Dr. Samuel Caruthers, 47, guilty of third-degree endangering the welfare of a child, simple assault, a disorderly persons offense, and fourth-degree unlawful possession of a weapon, the New Jersey Herald reports. After the 12-year-old ran into his son, Caruthers, who works as an anesthesiologist, punched him and stabbed him with a ski pole. The boy suffered a rib contusion and a busted lip. Sentencing, at which Caruthers faces up to seven years behind bars, is set for May 24.

The boy, now 15, says the collision was an accident. Caruthers said during the trial that he didn't realize the victim was a child, noting he was 5 feet, 7 inches tall, wearing thick ski clothes, and sporting goggles and a mustache. Caruthers' attorney is filing a motion to overturn the verdict, pointing out what he sees as problems with the jury's findings: Caruthers was found not guilty on charges of third-degree aggravated assault with a deadly weapon and third-degree possession of a weapon for unlawful purpose, and the lawyer says it's therefore inconsistent that he was found guilty on a separate weapons charge. He has issues with most of the other charges as well. "I believe when this is finally resolved, the only charge remaining will be simple assault," he tells NJ.com.
