Injuries violated restaurant's 'all-American cheerleader look'

(Newser) – An Iowa judge has awarded unemployment benefits to an assaulted Hooters waitress who says she was fired because her bruised "body wasn't up to par." Managers testified that the black eye and facial bruising Sara Dye suffered in a domestic violence dispute violated the company-mandated "glamorous appearance" and "all-American cheerleader look," the Des Moines Register reports.

Also at issue was Dye's hair, which had been partially cut off in the assault. The Hooters handbook states hair "needs to be styled as if you're going out on a big date on a Saturday night, as if you're preparing for a photo shoot."

FIRST OF ALL...No you dont have to put down your bust size that bs. I am a hooters girl of north little rock arkansas. There was a lawsuit of a hooters girl who was told to loose weight and shape up in 30 days or she would be fired...so she did so. She took off 30 days to do what what she was asked. She then was fired because she "abandoned" he duties at hooters. Almost every day if not every other day I have to buy a new pair of hose...and it cant but just any pair it has to be their pair. I have to constantly buy shirts because yes I am in the food business and I do get dirty. I have to buy socks because they are made of out cheap materials and often start to unravel and tear. I have to buy shorts because the orange fades no matter how cold of water you wash it in and don’t use a dryer to dry them. We are also made to wear skimpy uniforms like school girl outfits and such. On holidays like Halloween it is mandatory that we buy and wear a costume. I don’t see them paying for any of this. Not at all...not one single dime. Not only have I dealt with these things but I have dealt with a lot more. How about the days when they make us claim more than we make and tell us that sorry not going to change it because there are days we "make" more than what we claim. I don’t know about other hooter girls but in my contract it states that I have to claim 100% of my tips. Not only do I do that because of the contract but its hard to prove I make what I make to banks or loan agencies etc. Recently I was called into the office and was told that I "NEEDED" to get into shape and conform to the "HOOTERS" standard of an American cheerleader. I was told that my uniform did not fit correctly and that I was not super enthusiastic like a cheerleader. They then proceeded to tell me that I needed to get into a gym, get a personal trainer and get a nutritionist, for I was apparently not healthy and thin enough. I am 5'2" and 120 lbs. I have not gained a single pound since I have been hired; in fact I have done nothing but get better and lose weight. I constantly get compliments about how my shape is admired and how I am the best looking one of the group. Now maybe to some I am not but obviously to some I am. I have worked my hardest for this company for 2 and half years to only get spat in the face and told to basically throw my food up and starve myself or I will be terminated. Its acts like these that make young girls like me hate themselves and the way they look. Its acts like these that make young girls do the things they do to "fit" in like all the skinny girls. Well I refuse to do this. They hired me on the way I was and I have done nothing but better myself since then. So if was fired for someone beating her and all she is trying to do is get back to her way of life and move on then yes hooters should be sued. It says nothing about what happened to the partner...probably because it has nothing to do with the case at hand with hooters.

Okay first off, I am a woman and I hate when I see other women taking abuse.. its sad to me that she would rather sue her job for unemployment than suing her "domestic partner" for the loss of a job and then some.. If her appearance was enough to be fired for then take your "partner" to court..not your job. Then again she might have started it in which case still isnt right for her "partner" to touch her in that manor.. but she wouldnt have gotten much if all if she had started it... However my biggest pet peeve is that she won the battle against her employer.. she took the job AND signed a contract that clearly states that she is willing to look a certain way or she will be fired.. From what Ive heard you have to even put down your chest/bust size on the Hooters application, so anyone subjecting themselves to that type of employment should know better than to just show up with a black eye and unmatched hacked off hair... You wouldnt assume a striper/dancer in a bar to appear that way, so why if she signed papers would she think she could at this job??!

It sounds to me like she has a good civil case against her "domestic partner" for causing her to lose her job, too. Of course, I would sue Hooter's first. Pathetic!
