Reservist says he shouldn't have to serve since Obama isn't a citizen

(Newser) – An Army reservist has devised a creative way to try to avoid going to Afghanistan: He says he isn’t obligated to follow the commander-in-chief’s orders because Barack Obama isn’t a citizen and therefore can’t legally be president, reports the Ledger-Enquirer of Columbus, Ga. His attorney, who has represented others who have challenged Obama’s citizenship, filed a request to award Maj. Stefan Frederick Cook conscientious objector status. A hearing takes place later this week.

See the first sentence of Kokuaguy's reply. In 8 U.S.C. § 1403, the law states that anyone born in the Canal Zone or in Panama itself, on or after February 26, 1904, to a mother and/or father who is a United States citizen, was "declared" to be a United States citizen. Note that the terms "natural-born" or "citizen at birth" are missing from this section. This essentially says that McCain is not a "natural-born" citizen, however is still a citizen. -- http://www.snopes.com/politics... -- http://media.photobucket.com/i... -- The thing is, different states call "birth certificates" different things. Return of Birth, Certificate of Birth, Statistical Record, Birth Registration Notice, Certificate of Live Birth, Standard Certificate of Birth. Elvis's is call a Standard Certificate of Live Birth. So what's your problem? Obama presented one. What, you don't like what it's called?

Also, if you ever get around to reading my reply, you'll find that under 8 U.S.C. § 1403 John McCain is not "natural-born".

The thing is psycada, it's general knowledge. I could understand if someone found out that McCain was born in Panama and said hey wait, he can't run, and then looked up the code and found otherwise. The "birthers" have been given sufficient evidence yet continue their fruitless crusade.
