Obama Hails 'Historic' Sotomayor Confirmation

(AP) – Barack Obama is lauding the barrier-breaking confirmation of Sonia Sotomayor as the first Hispanic justice on the Supreme Court. “With this historic vote, the Senate has affirmed that Justice Sotomayor has the intellect, the temperament, the history, the integrity and the independence of mind to ably serve on our nation's highest court," Obama said. Sotomayor will be sworn in Saturday and will appear with Obama at the White House next week.

I know. You're right, Weglad. You have a pragmatist's viewpoint. But, it's hard, no matter the foolishness of it, to just walk away from these conversations, throwing hands in the air in acquiescence. Do I think these fundamentalists are so populous that, essentially, they outnumber moderates? No, not by a long shot, although it feels that way. The outlandish and inescapable thing of it is that these folks ... the birthers, the anti-"socialists," the Palin-ists, the moral "majority," the swiftboaters ... these folks have an extraordinary ability to appear so vast and influential, speaking louder, reaching farther, digging deeper into American media and culture and bearing down in clearly sinister ways on the tired, weary, woeful many who are frightened they'll lose their houses, won't get meds for their grandparents, have to send their kids to fight yet another "war on terror." Can we just stand by and let these folks speak so boldly they drown-out all reason and vision. It would be easy to cast them off as "trolls," to suggest their insignificance. But, my goodness, Bush won a shocking two terms (I'm still astounded by that) and we WILL pay the price for his appts. to the Court for the rest of our lives and beyond. And, as these "trolls" so aptly put it, we should be concerned about the race in 2010 and 2012, about who runs in our local elections, about The Family (have you heard about this fundamental religious organization which may well be writing the Republican platform?) We should be desperately afraid how close Palin came to the White House, and how dauntingly closer she really is now. And, what is there to do? We vote, we obey rules, stay informed. We care. We donate. Maybe write letters to editors, call our Senators and perhaps even protest. And it's not that all that doesn't matter. What bites is that these "trolls" and their organized effort to influence by fear and lies is so very effective. The seeming idiocy of it is, instead, really poisonous venom that seeps deep into the tissue and surfaces later when it seems to count the most. So, the rational, the reasonable, the informed, the adult ... what else can we do but appeal desperately, a little, to some vestige of sense that might lie within them and hope to at least dilute their impact?

I really do think we'll find that Sotomayor will grow to be a solid moderate on the Court. I think it's astonishing (with information on her rulings so easy to study) that anyone would see her as a liberal leaning (or worse) judge. She has done, in fact, an exceptional job of upholding the law, not creating new law. She has ruled on behalf of pro-business judgments and has upheld lower court rulings that some might even consider jurisprudently conservative. For any student of the High Court, one recognizes that good judges only get very better once they reach this position. That, I believe, we can hope for with her. She is perhaps better prepared than any other nominee in the last 4 or 5 decades. What she is NOT is a strict-constructionist (like a couple right-leaning members of the Court today). In this she, as the Founders intended, is prepared to interpret and uphold Constitutional Law and the Constitution as a living document, well aware of influences that arise as society grows that require re-examination of the jurisprudence of the Land. Our Founders never intended justices to sit on the High Court who did not understand that. That is a foundational tenet of justice in our country. Regardless, anyone foolish enough to not see Sotomayor as a well-prepared, brilliant and moderate/fair judge may very well be viewing her through either racist or sexist lenses. And ask yourself, if Bush had nominated her, would you see her differently? Odds are for her rabid critics, yes.
