(Newser) – Today’s decision by former Miss California Carrie Prejean to drop a lawsuit against the pageant came after one of its lawyers showed Prejean a sex tape that TMZ says it obtained “months ago but decided not to post … because it was so racy.” As part of the deal—which, TMZ adds, Prejean agreed to in “about 15 seconds”—the pageant pays her legal fees, but she gets nada.

Actually, it is blackmail. Though, in this case since it was a defensive move made against someone who is suing you for more than a million dollars, I'm not sure it's all that bad.

I think that blackmail is the word. Remember Monty Python years ago doing the 'Blackmail Show'? It was like the Price is Right but the moderator called people and said pay up or we show this video. As the people hedged they showed more of the video until they paid up before the face. That was decades ago, but they defined something very real about being human. We are all the person that we put out there on purpose--we aren't the people that someone steals from us in privacy and says this is you. Personally, something as normal as sex--drinking water--shouldn't be an anything and if we all treated it like a nothing it would eventually become that. On a side note--always look for the half-open closet and the little red light. Just a heads up to my girls who grew up before video.

No. The point of the pageant showing her the sex tape was to make it clear that they had plenty of evidence to support their claim that she did not have the moral character to hold the Miss California crown -- other winners in the Miss America pageant system have been disqualified for *far* less. It may be a bit of a puritanical standard, but it's the standard to which all contestants agree to be held. In other words, it was not a threat of "we'll release this if you don't drop your lawsuit" (that would be blackmail), but rather just a warning that her case was utterly without merit.

@rrmacgregor - though i agree with a lot of what you said, the only thing i have a problem with is the fact that it's just a damn sex-tape. Everyone has the right to have a little fun, especially something so primitive as having sex. I don't know why everyone gets so up in arms about sex tapes. The real question is, was it made by a peeping-tom, or released by a jilted-ex? None the less, just cause she'd be a pageant contestant, doesn't mean she can't have sex with someone. Just means she's gotta be careful who she does it with. People have GOT TO LEARN, unless you want the world to know about it, don't tape it!

Plenty of hypocrisy on both sides, if you ask me. Can anyone say John Edwards? Or the Rev. Jesse Jackson? But hypocrisy in the sexual arena will come for anyone who is reluctant to admit that sex is good and we should be having lots of it. Or for people who agree to monogamous contracts when they should know they won't be able to fulfill them.

I don't see such hypocrisy there. Sure Edwards and Jackson messed up in scummy ways. But their main messages are not about denying anyone their rights simply because of sexual preferences. Prejean's crusade was to punish gays for their sex acts. She really stands for nothing else other than perhaps women with small boobs should get them changed. (Nice message there, church girl) Prejean, Craig, and Foley all try to keep down the gays while hiding or denying their own sexual shenanigans. I have no problem with her sex tape or even Craig hitting on dudes in public restrooms. I do have a problem when they try to control others sex lives. For the record, I do have problems with Foley. That Republican is a pedophile. That is one type of sex act that really should be denied. Call me old fashioned on that if you like.

What about the idea that Edwards made a promise to his wife not to cheat on her, or the fact that Jesse Jackson is a Christian minister who tries to tell people not to have sex outside of marriage. Both sides are filled with sexual hypocrisy, although you're right, that the Right has much more of it.

They might not have aired the video (yet), but they did publish the news of it's existence, which is the main thing anyway. So, if she made the deal to cover its existence, TMZ screwed her over. Actually, if christians could get their "word of god" straight and stop changing it every time it pleases them, she was sinning. The catholic church was the last to rewrite the sin of masturbation out of it's sacred word of god in 1967. Like most churches, they rewrote it to condemn homosexuals.
