Pub's Bad Service Leads to Arrest—of Irate Patrons

No skipping gratuity, restaurant says

(Newser) – Turns out that mandatory 18% gratuity for large parties at restaurants is mandatory enough that skipping it can get you arrested. A Philadelphia-area couple who found service at a pub was so scarce they essentially waited on themselves and their six friends ended up in cuffs when they refused to tip their server. “I understand that, you know, we didn’t pay the gratuity,” one of the patrons tells NBC Philadelphia, “but it was a gratuity, it wasn’t something that was required.”

After waiting nearly an hour for their order and fetching their own napkins, silverware, and drink refills—because the waitress never came back, says the customer—they made their intentions known to the bar manager, who promptly called the cops. Police charged them with theft because the tip actually was required. The bar says it offered to comp the food; the diners say they don’t recall that.

I don't see the mandatory gratuity. I know that many places will add it to the bill on parties over a certain number, but I think that the patrons should also have the right to not pay when there is bad service. I wonder if they went to the manager about the service they were getting? Reply

try working in the service industry for a year and then say that...grant it, if the server sucked they should get much less than the 18% they should be entitled to, but youre talking about someones job. as for being arrested, that is just plain retarded.

I do have relatives that work as waiters so I don't dismiss it. I do try to tip the 15 to 20%, but I also don't believe that the bill should be automatically added to the tab. You need to earn the tip, not be rewarded for no service. That is why though I asked if they had went to the manager about the service they recieved.

panninthru - "entitled to!?" Listen, if someone treats me well I tip well (25-30% for outstanding service), if they do what's expected I give them 15-20%, and if they suck they're lucky to get 10%. But I would never leave a single penny for someone if I got the idea they felt ENTITLED to my money. No one (besides Uncle Sam, unfortunately) is ENTITLED to my money but me. End. Of. Story.

I tip very generously when service is exceptional. And I have left nothing, on a couple occasions, when service wasn't service. In the end, you reap what you sow. 18% gratuity added to parties of 6, 8 or more can always be negotiated, as it is gratuity for service, not the meal. This story sounds fabricated, fictional. And yes, I waited tables, too. My job was to please, and if I didn't, I knew exactly what to expect, and rightly so.
