Casey Anthony Will Face Death Penalty

Defense argued sentence violated accused baby-killer's rights

(Newser) – Casey Anthony is eligible to face the death penalty if convicted of first-degree murder, a Florida judge ruled today. Her lawyers had asked that execution be taken off the table in her trial for the murder of her 2-year-old daughter, Caylee, arguing that if the prosecution sought the death penalty, it would violate their client’s constitutional rights. The judge said that's for a jury to decide, the Orlando Sentinel reports.

"While the quantum of evidence sufficient to seek the death penalty will virtually always be an issue, that matter is generally best left for the jury,” the judge ruled.

It's really become a sad world all of these crazy a$$ mothers killing their kids, there is a special spot in hell reserved for people like this. I say give her life make her suffer as much as possible and really what could be worse for a child killer than to sit in prison with people that will beat her ass for years for what she did to that little girl. It's something like 55% of woman in prison have kids I don’t think they like her too much "Revenge is a thing best served cold"

I did give you a thumbs up sidewinder because a philosophically good question. When does life begin? Obviously this little girl was alive and therefore it was murder, however, those against abortion (as i suspect you are) consider a person to be alive when the sperm meets the egg. Yet at this point the creature is just a cell. Why is it acceptable to kill a fully grown cow for a steak but not acceptable to kill a cell? how come we are allowed to kill Bacteria in our body but not a cell in our body created from a sperm and an egg? Furthermore, how come it is legal to masturbate and that is not considered murder? These cells have the potential to become human yet when someone masturbates they effectively kill that potential.

@SPH, I'm with you, there are rights for the accused (fair,speedy trial, etc.). But the death penalty has never been ruled a violation of a criminal's rights in court of law (Federal or Florida). The defenses' argument that the death penalty violates her constitutional rights, is bogus. By violating the rights of an individual,the rights of the perpetrator(s) are forfeited. I think Locke or Rousseau argued that.
