Toni Tramel had been arrested for public drunkenness, a misdemeanor. But when the 31-year-old Kentucky woman was putting on her inmate uniform, she allegedly squirted a stream of breast milk in the face of the female deputy watching her, WYMT-TV reports. After cleaning the “bio-hazard” off her face, the deputy saw that Tramel was charged with third-degree assault, a felony.

But that charge has sparked some debate over whether using breast milk as a weapon is really a felony-level offense, according to Fox News, “with many readers likening it to an accused person spitting on an officer.” Others have objected to the police press release’s use of the term “bio-hazard” to refer to breast milk.
