(Newser) – Britney Spears must surrender their two children to ex-hubby Kevin Federline on Wednesday, and he'll have custody "until further notice of the court," People reports. The fallen pop princess is facing misdemeanor charges of hit-and-run and driving without a license as well as an ex-bodyguard's allegations of habitual drug and alcohol use.

Spears and K-Fed had split custody of their 1- and 2-year-old sons equally before today's ruling. The news came after Federline's lawyers had a private session with the judge and after the embattled pop singer was seen this weekend in good spirits with her children at a Malibu restaurant.
