Upholds federal panel's decision on poor prison conditions

(NEWSER) - In a 5-4 decision, the Supreme Court has upheld a panel’s order that California release 46,000 inmates over the next two years to reduce overcrowding in state prisons. In 2009, a three-judge panel called on the state to reduce its prison population to 137% of capacity; overcrowding was resulting in poor medical care for inmates, which violated the Constitution, the panel said. The high court was faced with the question of whether the panel had the authority to issue such an order regarding state prisoners. More»

Kids in nonhomicide crimes must at least get chance at parole

(AP) - The Supreme Court ruled 5-4 today that teens may not be locked up for life without chance of parole if they have not killed anyone, holding that the Constitution requires that young people serving life sentences must at least be considered for release. The court ruled in the case of Terrance Graham, who was implicated in armed robberies when he was 16 and 17. Graham, now 22, is in prison in Florida, which holds more than 70% of juvenile defendants locked up for life for crimes other than homicide. More»

(NEWSER) - You can take his freedom but you can't take his cigarettes, a British inmate is arguing in court. Jack Richard Foster is suing prison authorities, claiming they violated his human rights and imposed cruel and unusual punishment when they took away his tobacco for a week as punishment for swearing at a prison officer. Foster's lawyers say that as a tobacco addict, he should have been offered nicotine patches, the Telegraph reports. More»

(NEWSER) - Living on death row looks like a better deal than dying as a lifer, convicted killer Billy Joe Johnson told a California jury yesterday. "You get out of your confined cell a little more," said Johnson, whose trial has moved to the penalty phase after he was found guilty of killing a fellow member of a white supremacist gang. Johnson, 46, is already serving a 45-year sentence for another killing. He told the jury he also killed two other people. More»
