Judge's decade-long same-sex relationship a conflict of interest

(Newser) – The ruling against California's controversial Proposition 8 should be set aside, a group argued yesterday, not because the judge who ruled against it is gay—but because he's in a long-term relationship with his partner. ProtectMarriage, which sponsored the 2008 ballot initiative prohibiting gay marriage, filed a motion asking a district court to vacate Vaughn Walker's ruling because his 10-year-long same-sex relationship created a conflict of interest, the Los Angeles Times reports.

Walker's sexuality came up more than once during the trial, but this is the first time ProtectMarriage has made an issue of it. The move follows Walker's recent disclosure of his long-term relationship; attorneys for the group argue that because the relationship was serious and could have led to marriage, the judge had a direct interest in the outcome of the case and should have either recused himself or fully disclosed the relationship. But the Times notes that Walker's partner was widely known in San Francisco's legal circles and accompanied him to law events, and a law school dean says there's "no chance whatsoever" the court will void Walker's ruling on such grounds.

So, I guess it would be fair to put an anti-gay religious cult member on the court because the outcome wouldn't concern him/her at all. In fact the vote and ruling has no impact on anyone but gay people. Their sanctity of marriage issue is misdirected. If you want sanctity of marriage - don't allow divorce, quit changing the vows – the bible says that a woman should obey her husband. If the bible is actually followed, a man should never, ever, under any circumstances, marry a divorced woman. An easy fix would be to completely separate the civil marriage/union from the religious ceremony; ensure everyone has a civil union that is sanctioned by the government and if you want to have your ceremony ordained by your specific religion, then so be it - I won't judge your superstitions.

Of course there is a conflict of interest. The homosexual judge had a vested interest in the outcome of his decision.

Lets just solve all of the problems. if you want to get married, go to a church. You want an end to your marriage, see a clergy. If they say no divorce, or no annulment, then no divorce, no annulment. If you want a 'civil union' then do it outside of a church. Gay or straight. You want a divorce, see a judge. Now the church can set up whatever restrictions they want on the sanctity of marriage, and everyone else can enter into a 'contract' with their partners until they no longer want to be in the contract. At that time they can go to a judge to end it.
