Holder to Judge: Yes, Obama Respects High Court

He had to defend president's comments on judicial activism

(Newser) President Obama may have warned "unelected" justices about judicial activism, but that doesn't mean he opposes judicial authority, Eric Holder says. Following Obama's comments, a federal appeals court judge ordered the Justice Department to explain its views on the matter in three pages; Holder did it in two and a half, the Washington Post notes. The attorney general asserted that the administration believes in the court's right to rule on the law, USA Today reports.

"The power of the courts to review the constitutionality of legislation is beyond dispute," Holder wrote, adding that "the President's remarks were fully consistent" with that view. But Holder reminded the court that it should show "deference" to Congress' "legislative judgments." The high court "has often acknowledged the appropriateness of reliance on the political branches’ policy choices." In the memo, Holder also offered what the Post calls "an apparent critique" of Judge Jerry Smith's demand. "The question posed by the court ... does not concern any argument made in the government’s brief or at oral argument in this case."

I say attorney general Holder is over stepping his power, the people of California have voted into law medical Marijuana. Now they are busting these stores, and bankrupting them with bogus taxes they made up. All to protect their real bosses the incorporations and their profits. Can one person tell me how hemp is a danger to the plubic.  If you compare hemp to marijuana ,it would be comparing apples to baseballs. This is just another sign that the replubicians do not want free markets.

Our only jailed attorney-general was Nixon's first, John Mitchell!   Did he break the law?   Is any conservative Republican angered by that?   Any Conservative angered by the selling of arms to Ayatollah Khomeni?   Iran-Contra?

Yea Judge, what did you expect from Obama, who has a useless worthless minority Harvard Law Degree, with a real high school education. -- Come on Judge give him a break, it's Bush and the Republicans fault he didn't get a REAL education. -- PS; I'd like to get one of those useless worthless minority Obama Harvard Law Degrees, for my dog.--------- REALLY
