It's been a rough year or so for Tameka Foster. Usher's ex-wife lost her 11-year-old son in a tragic boating accident last July; then on Monday, another son and another water-related calamity. Usher Raymond V, 5, nearly drowned after getting partly stuck in the drain of the swimming pool he was in at an Atlanta home. His famous father, who has custody of the child, wasn't present; his great-aunt and a housekeeper failed in their attempts to free him, but a contractor working on the home's sound system was able to pull the boy out and perform CPR, reports the Atlanta Journal-Constitution.

The boy is expected to recover. Usher's custody of his two sons with Foster, however, is at risk. NBC News reports Foster has filed paperwork requesting an emergency custody hearing. "(The) children are at risk while in the care of third-party caregivers, while (Usher) travels around the world for his work-related obligations." TMZ adds that Foster has long had a beef with the aunt who was watching the child on Monday, having formerly complained that she let a stalker into the house. (More Usher stories.)
