(Newser) – On the upside, some people caught evidence of an alleged sexual assault on Instagram over the weekend, which may help police investigate the incident. On the downside, those people posted the pictures and videos online, but didn't call police or otherwise try to stop it. The photos and videos show a man performing oral sex on a woman on a public street. The woman, a 20-year-old Ohio University student, filed a rape complaint on Sunday, after the clips quickly circulated online, college newspaper the Post reports here and here.

Athens police say they have identified the man and he is cooperating, reports the Athens News. Now they must determine whether the woman was drunk, and therefore unable to consent to the act. The university police chief slammed the onlookers, both for taping without helping, and for later shaming the victim online. "There have been some real examples of some victim-blaming behavior," he says, per the Post. "What is more disturbing are the social implications of what it means for someone to have been standing there watching this thing happen, videotaping it with their phone instead of getting involved and trying to help the victim."

Ruth Brown and Newser, I do not trust your reporting. You are not being impartial by calling this a "sexual assault". Your title vaguely attributes this to "cops" but it is doubtful that a cop would say something non-neutral like this. Ruth, who is this mysterious "university police chief" who allegedly called this girl a 'victim' before the case had gone to trial? Cite your sources, or we'll think you made it up!

Really drunk people often smile and seemingly comply- even when they can't remember what happened later. YouTube is overrun with videos of them. I could believe that she is "out of it." On the other hand, he looks pretty clear-eyed to me. Unless he confesses that he raped her, it will go to trial and the jury will decide if it was or not. There will be both men and women on the jury, and defense attorneys in rape cases are skilled at making sure no "feminazis" make onto the jury. Like all similar cases, the jury will most likely hear evidence that we will never hear. We have to trust that justice will be done, and that the guilty one is the one who will be found guilty.

since when can a drunk women not consent to sex? jesus the entire nation would be locked up if that's rape. The girl is a freak and then filed a FALSE REPORT to avoid the well earned shame she deserved. that ho should be charged and the man should be given restitution under the crime victims fund. some women are total trash.
