Judge Tosses 'Frivolous' Birther Lawsuit

Peeved judge tells Orly Taitz not to waste his time with any similar suits

(Newser) – Leading "birther" Orly Taitz had a lawsuit chucked out of court yesterday and the judge threatened her with sanctions if she brings another “frivolous” suit to the same court, the Columbus Ledger-Enquirer reports. Taitz—representing a soldier seeking to avoid deployment to Iraq by challenging President Obama's legitimacy—"presented no credible evidence," Judge Clay Land wrote in a withering judgment, but instead "uses her complaint as a platform for spouting political rhetoric, such as her claims that the president is ‘an illegal usurper.'"

"Unlike in Alice in Wonderland, simply saying something is so does not make it so,” Land, a Bush appointee, wrote, observing that a high school civics student could spot the irony in Taitz's claims that the burden of proof is on Obama to prove his "natural born" status. After the judgment, Taitz vowed to continue fighting and compared herself to Nelson Mandela. "Judge Land is a typical puppet of the regime—just like in the Soviet Union," she told TPM.

Then he has to be our first half-white president. Not too many years ago, if Mr. Obama were born in Louisiand, and was '1/32 negro blood', he was black. Period. A lilly white man to the back of the bus, to the black fountain at the bus station. To the black fountain in the Kresge 5 & 10 cent store. There's how ridiculous it all is.

Orly's client is a 'she'. She is Captain Connie Rhodes, United States Army. She is a military physician. She had her third and fourth year of medical school paid for by the United States. She agreed to serve as a military physician for two years for this consideration. She is a coward, for she has not failed to follow any other orders issued to her by the Army during President Obama's period as Commander in Chief. She objects to being sent to a war theater which has some dangers. This officer should be court martialed for failure to follow orders, be reduced in rank, billed the cost of her eduction plus interest, imprisoned for the period of her deployment to Iraq, then thrown out of the Army with a dishonorable discharge. What a fool she has been to let the birther wingnut sheister lawyer bring this case.
