Democrats to Play Offense in Court Fight

Will attack 'conservative judicial activism,' citing Citizens United ruling

(Newser) – “Judicial activism” isn’t just a conservative buzzword anymore. Democrats intend to use the upcoming confirmation battle over John Paul Stevens’ successor to argue that it’s the conservatives on John Roberts’ court who are litigating from the bench, high-ranking Democrats tell Politico. Exhibit A: The wildly unpopular Citizens United v. FEC ruling, which eliminated virtually every check on corporate political spending.

Expect the nominee to hear questions like, “Do you share our concern that the court always seems to side with the big corporate interests against the average American?” says Patrick Leahy. But Republicans evinced indifference about the frantic strategizing. “Are you telling me they want to use the Supreme Court confirmation for political purposes?” said a Mitch McConnell spokesman. “They told us we weren’t supposed to do that.”

Citizens United v.FEC is an abomination. The Court has essentially sanctioned the supremacy of large corporations over individuals. It is yet another step toward the United States of American, Inc, a world where corporate interests rule and the needs and rights of the individual are subordinate to the interests of profit. It is the opposite of Communism, in that the Corporations own everything, and the people are simply viewed as fodder: produce and buy......and shut the fuck up.

This Supreme Court is the absolute worst in history, and Scalia and his band of old white guy cronies are in the pocket of the rich.

We can only hope that Obama is in office long enough to return the Court to the principles of the Constitution rather than the benefit of the corporate state.

Bending interpretation of the constitution makes me wonder why have it at all. Hell, Interstate Commerce is like the Bacon Factor of how to get away with passing any federal law. Its not a matter of if something counts, its how many steps does it take to get there. Try this.. People may not have fingernails longer than 2 inches. Clippers are made from metal, metal crosses state lines, viola.. constitutionally viable mandate. The whole thing makes me sick.
