Dark Knight Prosecutors Give Up Fight for Notebook

Dark Knight shooting suspect James Holmes had a court hearing today, and his physical appearance is getting just as much play as the legal developments. His bushy orange hair is gone, replaced by a crew cut of his natural brown hair. The description from AP: Holmes "appeared more animated during the hearing. He smiled and glanced around the courtroom, looking at his lawyers and reporters covering the hearing. He appeared to be moving his mouth but not actually talking."

At the hearing, prosecutors dropped their fight to get their hands on a notebook that Holmes mailed to his psychiatrist just before the shooting, reports the Denver Post. The prosecution fears the legal battle over the notebook would delay the trial too much. Plus, they might get a peek if Holmes uses an insanity defense. The notebook reportedly contains plans for the attack and could shed light into Holmes' state of mind. (More James Holmes stories.)
