Texas officer initially claimed he had killed burglar

(Newser) – Brothers Robert and Rocky Lee have more than 60 years of law enforcement between them, and something happened between them that left one brother dead and the other in jail, police in Texas say. CNN reports that police say Rocky Lee, a 26-year veteran of the Harris County Sheriff's Office, was shot dead by Robert Lee, an officer in the town of Stagecoach with 35 years in law enforcement. Officials say Robert Lee, 59, initially claimed to have killed a burglar, but they now believe that story was false and Rocky Lee, 57, was performing a welfare check on his brother when he was shot, the AP reports. Police say he was shot multiple times in the bathroom of his brothers home.

"I have fired shots into this young man and I cannot locate him on my property," Robert Lee said in a call to police Friday. "I'm a police sergeant with the City of Stagecoach. This man has broken into my house and I have fired five rounds into him and I cannot locate him at this time." Robert Lee, who also served on the Houston force, was taken into custody Friday night and treated for high blood pressure. He was charged with murder Saturday. Killing a police officer is a capital crime in Texas, but police say it won't apply in this case because both brothers were off duty at the time of the shooting, the Houston Chronicle reports.
