Judge Tosses 'Frivolous' Birther Lawsuit

Leading "birther" Orly Taitz had a lawsuit chucked out of court yesterday and the judge threatened her with sanctions if she brings another “frivolous” suit to the same court, the Columbus Ledger-Enquirer reports. Taitz—representing a soldier seeking to avoid deployment to Iraq by challenging President Obama's legitimacy—"presented no credible evidence," Judge Clay Land wrote in a withering judgment, but instead "uses her complaint as a platform for spouting political rhetoric, such as her claims that the president is ‘an illegal usurper.'"

"Unlike in Alice in Wonderland, simply saying something is so does not make it so,” Land, a Bush appointee, wrote, observing that a high school civics student could spot the irony in Taitz's claims that the burden of proof is on Obama to prove his "natural born" status. After the judgment, Taitz vowed to continue fighting and compared herself to Nelson Mandela. "Judge Land is a typical puppet of the regime—just like in the Soviet Union," she told TPM.
