Charlie Sheen isn't winning anymore. The actor failed yesterday to win sole custody of his twin sons from estranged wife Brooke Mueller in a Los Angeles court, sources tell ABC News. Mueller—who has reportedly returned to rehab for treatment of a drug problem—will maintain primary custody of the boys. Mueller looked delighted, while Sheen appeared crestfallen as the two exited court. The couple's divorce becomes final on May 2. After his day in court, Sheen flew to Washington, DC, for another appearance on his "My Violent Torpedo of Truth/Defeat Is Not An Option" tour.

As one group of lawyers discussed Sheen's family life, attorneys on the other side of Los Angeles were dealing with his career, notes the Hollywood Reporter. Sheen's lawyers argued that his $100 million lawsuit against Warner Brothers and Two and a Half Men creator Chuck Lorre should be heard by a judge in open court, while opposing lawyers argued that the case should be sent to private arbitration.
